New Law Ends Widow Penalty 

A new law ending the widow penalty was passed at the end of October 2009. 

 

The law provides self-petitioning rights for all widow(er)s of American citizens and their children.  Formerly, only widow(er)s who were married two years or more were able to self-petition. In addition, the law provides certain survivors' rights for other immigrants.  A new section of the Immigration and Nationality Act will allow certain petitions filed prior to death to be adjudicated despite the death of the petitioner or the principal immigrant. Restrictions apply.
