A new law ending the widow penalty was passed at the end of October 2009.
The law provides self-petitioning rights for all widow(er)s of American citizens and their children. Formerly, only widow(er)s who were married two years or more were able to self-petition. In addition, the law provides certain survivors' rights for other immigrants. A new section of the Immigration and Nationality Act will allow certain petitions filed prior to death to be adjudicated despite the death of the petitioner or the principal immigrant.
