US-VISIT is an automated entry-exit system used to record biometric information (i.e. fingerprints and pictures) of non-U.S. citizens as they enter or depart the U.S. The Department of Homeland Security (DHS) has published an interim rule that would expand and re-define the scope of US-VISIT. The new rule would expand the program to the 50 most highly trafficked land border ports of entry to the United States. Also, the rule further defines which non-citizens are subject to US-VISIT, including those who enter under the Visa Waiver Program. The rule announces that, while DHS has the authority to require Mexican nationals with a Border Crossing Card to provide biometric data on arrival or departure, such entrants who are not required to be issued form I-94, will not be subject to US-VISIT.
